WYOMING DRIVING WHILE UNDER THE INFLUENCE
(DWUI) LAW
It is illegal to drive in the state of Wyoming with A BAC of 0.08 % or
higher, 0.04 or higher if driving a commercial vehicle, or if you are
younger than 21 years of age and are in actual physical control of a
vehicle with an alcohol concentration of two one-hundredths of one
percent (0.02%) or more, you will be suspended for DWUI.
If you refuse to submit to all required tests for the above offense, your
license will be suspended for 6 months for the first offense and for 1
year and 6 months for the second offense ( second offense includes
previously convicted DWUI offense or refusal ).
Driver License Suspension Penalties for A DWUI In Wyoming
1ST OFFENSE (within previous 5 years)
a) Length of suspension - 90 days. (If you served or are serving a
suspension for Administrative Per Se, the suspension period will be the
same. If you are serving a suspension for refusing to submit to the
chemical test, the DWUI suspension will start after the refusal
suspension is over.)
b) Eligible for probationary driver's license - Yes, if you have not had one
in the past 5 years.
c) Reinstatement requirements - Completion of all withdrawal actions
on record; obtain a SR-22; and pay reinstatement fee.
2ND OFFENSE (within previous 5 years)
a) Length of suspension - 1 year. (If you served or are serving a
suspension for Administrative Per Se, an additional 9-month
suspension will be added to your record. If you are serving a
suspension for refusing to submit to the chemical test, the DWUI
suspension will start at the end of any suspension on record.)
b) Eligible for probationary driver's license - No, according to Wyoming
Law. (Limited driving privileges cannot be issued for any DWUI after the
first offense.)
c) Reinstatement requirements - Completion of all withdrawal actions
on record; obtain a SR-22; and pay reinstatement fee.
3RD OR SUBSEQUENT OFFENSE (within previous 5 years)
a) Length of revocation -3 years.
b) Eligible for probationary driver's license - No, according to Wyoming
Law.
c) Reinstatement requirements - Completion of all withdrawal actions
on record; obtain a SR-22; and pay reinstatement fee.
d) Re-licensing requirements - Investigation by department.

Probationary Drivers License In Wyoming
If you've had a probationary license on another suspension within the
past 5 years, you are not eligible. If the suspension is for a DWUI, a
probationary license can only be issued for the first DWUI. If it is your
second or subsequent DWUI, within the past 5 years, you cannot get a
probationary driver's license. Other actions that prohibit the issuance of
a probationary driver's license are revocations, cancellations,
disqualifications, and indefinite suspensions.
