Idaho DUI - Drivers License Suspension Laws/Penalties
In the state of Idaho, you can be convicted of a DUI if your blood alcohol
content (BAC) is over .08%. If you are under the age of 21, you can be
convicted if you test with a BAC of .02% or higher. It is also illegal to
operate a commercial vehicle with a BAC level of 0.04% or more (The
State of Idaho does not issue restricted CDL permits).
Under Idaho law, if you refuse to take a BAC test, your driver’s
license will be taken away and your driving privileges will be suspended
for 1 year along with a $250 civil penalty. If the officer suspects you are
using drugs, he can request an additional test to determine drug use.
First Offense DUI
Fine: Up to $1,000
Jail: 2 days to 6 months
Suspension Of License: 180 days with at least the first 30 days absolute
and the remainder restricted
Alcohol Evaluation: Yes
Probation: 1 to 2 years probation
Second Offense DUI (within a five year period)
Fine: Up to $2,000
Jail: 10 days to 1 year
Suspension Of License: 1 year absolute
Alcohol Evaluation: Yes
Interlock device will be required on car for 1 year after driver's license
suspension ends
Probation: 2 years
Third Offense DUI
Considered a felony DUI if it is received within 5 years of the first offense
or within 10 years of a prior felony DUI
Fine: Up to $5,000
Jail: 30 days to 5 years
Drivers License Suspension: 1 to 5 years with the first year absolute
Probation: Yes
Ignition Interlock: Yes
Enhanced Penalties For A BAC Level Of .20 Or More
First Offense DUI - Misdemeanor violation
Jail: 10 days mandatory, up to 1 year
Fine: up to $2,000
Drivers License suspension: 1 year mandatory after release from
confinement with no driving privileges of any kind
Second Offense DUI (within 5 Years) - Felony Violation
Jail: mandatory 30 days in the county jail, or up to 5 years in the state
penitentiary
Fine: up to $5,000
Drivers License suspension: up to 5 years, 1 year mandatory after
release from confinement with no driving privileges of any kind
Ignition interlock: Yes
Aggravated DUI - It is a felony to cause serious injury to another
person while driving under the influence. Jail time, fines and driving
suspension are enhanced which can include 30 days jail to 15 years
prison, up to a $5000 fine and one to five year license suspension
starting after release.
Driving under a suspended license because of a DUI should be avoided
at all cost because it is considered a crime in Idaho. Penalties include
jail time,fines, and an additional license suspension.
